The Bill and its subsidiary legislation will provide for the scale of manning of Hong Kong-registered ships according to their tonnage and type. Such manning scales will need to be observed wherever the ship may be.
Employment and Discharge of Seafarers
Procedure upon employment and discharge and provision for seafarers left behind or remaining in Hong Kong.
The legislation will require that proper employment and discharge and due provision for subsistence and maintenance of seafarers discharged in Hong Kong from any ship are ensured
(a) by the relevant consular office in Hong Kong if the flag state of the ship in question has such an office in Hong Kong; or
(b)
by the Superintendent in respect of ships registered in Hong Kong and ships whose flag states do not have consular officers in Hong Kong.
Crew agreements.
A
Hong Kong-registered ship will be required to carry a crew agreement for each of its seafarers whenever it goes to sea.
Right, or loss of right, to wages in certain
circumstances.
The legislation will provide for the right, or loss of right, to wages for seafarers on Hong Kong-registered ships, e.g., where
ship has been wrecked, lost or sold or cease to be registered in Hong Kong. These provisions will apply wherever the ship may be.
