other parties in 1988. It provides for cooperation in the design,
development, operation and utilisation of a permanently manned civil
space station, planned to operate from the late 1990s. While the space

station project is subject to close Congressional scrutiny and is now
under a tighter budget regime than originally planned, work on the
project is going ahead in the US, although some rescheduling and
redesign is likely.

The IGA includes provisions on intellectual property rights (IPR) in
respect of space station elements registered by ESA, the cross-waiver of
liability by partner states in the event of claims for damages arising
from activities carried out under the Agreement, the facilitation of the
movement of persons, goods and data needed to implement the Agreement
and the exercise of criminal jurisdiction over space station elements
and personnel. Legal advice is that to safeguard UK interests domestic
legislation is required to implement the provisions in respect of IPR
and criminal jurisdiction. The legislative requirements are described
in rather more detail in the Annex to this Memorandum.
The other
matters can if necessary, be dealt with through administrative actions.
