THE PROBLEM
Annex III to the International Convention for the Prevention of Pollution from Ships 1973 as amended by its 1978 Protocol ("the Convention") will come into force internationally on 1 July 1992. We have to decide whether that Annex should be extended to Hong Kong.
RECOMMENDATION AND ADVICE SOUGHT

It is recommended that Hong Kong should seek the extension of Annex III to the Convention to the territory, subject to consultation with the Chinese.

Members will be asked to advise whether this recommendation should be approved.
BACKGROUND AND ARGUMENT
Background

The Convention was adopted by the Inter-governmental Maritime Consultative Organisation (IMCO), the predecessor to the International Maritime Organisation (IMO), to eliminate deliberate and negligent pollution of the marine environment by oil and other harmful substances and to minimise accidental discharge of such substances. It has five Annexes, each stipulating controls specific to a particular group of pollutants, as follows -
(a) Annex I - oil;
(b) Annex II - noxious liquid substances in bulk;
(c)
Annex III - harmful substances carried by sea in packaged form;
