Protection of topographies of ICs in Hong Kong.

Mr Peter Britton (IPCD DTI) recently sent me a copy of your letter of 18 May. We thought that in view of your intention to introduce legislation in Hong Kong in the near future concerning the protection of layout designs of ICs that we should draw your attention to EC Directive 87/54/EEC and EC Council decision 90/511/EEC. The 1987 Directive gives a certain level of protection to Community chip designers ( the corresponding legislation in the UK is the Copyright, Designs and Patents Act 1988, as modified by the Design Right (Semiconductor Topographies Regulations 1989 no 1100 ). The 1990 Decision provides interim reciprocal protection up to December 1992 to nationals or companies of the countries or territories listed in an Annex to the Decision to allow them to introduce new laws to provide full protection for chip designers. For ease of information I attach copies of both the 1987 Directive and the relevant Council Decision.

2. Both Mr Britten and myself are not sure whether the timescale aligned to the Council Decision has ever been drawn to your attention in the past, but in view of this you may now wish to draw the date of your proposed legislation forward to the end of this year.
