(2) The specific method for electing members of the Legislative Council will be specified by an electoral law introduced by the Macao SAR government and passed by the Legislative Council.

(3) If there is a need to amend the method for electing members of the Legislative Council of the Macao Special Administrative Council for the terms subsequent to 2009, such amendments must be made with the endorsement of a two- thirds majority of all members of the Legislative Council and the consent of the Chief Executive and they will be reported to the Standing Committee of the National People's Congress for the record.

Annex III: National Laws Applicable in Macao SAR

The following national laws will be applied locally with effect from 20th December 1999 by way of promulgation or legislation by the Macao SAR:

(1) Resolution on the Capital, Calendar, National Anthem and National Flag of the PRC.

(2) Resolution on PRC National Day.

(3) Declaration by PRC Government on Territorial Scas. (4) PRC Nationality Law.

(5) PRC Regulations concerning Diplomatic Privileges and Immunities

(6) PRC National Flag Law.

(7) PRC National Emblem Law.

(Appendix): NPC Decision on the Method for the Formation of First Macao SAR Government and Legislative Council (Draft)

(1) The first Macao SAR government and Legislative Council will be formed in accordance with the principles of state sovereignty and smooth transition.

(2) Within the year 1998, the NPC will establish a Macao SAR Preparatory Committee, which will be responsible for preparing the establishment of the region, and will prescribe the special method for forming the first government and legislative council in accordance with this decision. The Preparatory Committee will be composed of mainland members and Macao members, who will constitute not less than 50 percent of its membership. Its chairman and members will be appointed by the NPC Standing Committee.

(3) The Macao SAR Preparatory Committee w responsible for preparing the establishment of the Scle Committee for the first government of the Macao SAR (t "Selection Committee").

The Selection Committee will be composed entirely of permanent residents of Macao and

It will include Macao deputies to the NPC, representatives of Macao members of the National Committee of the CPPCC, persons with practical experience who have served in Macao's executive, legislative, and advisory organs prior to the establishment of the Macao SAR, and persons representative of various strata and sectors of society.

(4) The Selection Committee will recommend the candidate for the first Chief Executive through local consultations, or through nomination and election after consultations, and report the recommended candidate to the central people's government for appointment. The term of office of the first Chief Executive will be the same as the regular term.

(5) The Chief Executive of the Macao SAR will be responsible for preparing the formation of the first government and the SAR in accordance with this Law.

(6) The first Legislative Council of the Macao SAR will he composed of 23 members, with eight members returned through direct elections, eight members returned through indirect elections, and seven appointed members. If the composition of the last Macao Legislative Council before the establishment of the Macao SAR is in conformity with the relevant provisions of this decision and the Basic Law of the Macao SAR, those of its members who uphold the Basic Law of the Macao SAR of the PRC and pledge allegiance to the Macao SAR, and who meet the requirements set forth in the Macao Basic Law may, upon confirmation by the Preparatory Committee, become members of the region's first Legislative Council. If there are vacancies, they should be filled according to the decision by the Preparatory Committee of the Macao SAR.
