It is for consideration whether the closure of Shek Kong for refurbishment should not very quietly be delayed. The Secretary for security would need to advise
further on this.

A freeze on JLG work, which seems inevitable, poses us no very serious problems in the short term. The area where most work goes on is legal matters. A total hold-up of 6 months would have only a marginal effect on Mr Edwards' various projects. If the hold-up were to be more than 6 months, the
programme of negotiations on fugitive offenders, mutual legal assistance and reciprocal enforcement of civil judgements would be very unlikely to be completed by 1997. A delay of a year or more would mean that we would, in addition, probably be unable to complete the programme of negotiations on IPPAS. It would also leave little time for legal and procedural arrangements to be agreed between Hong Kong and the PRC. If we are unable to secure Chinese agreement on localisation and adaptation of legislation we could act unilaterally and hope that the results would not be overturned after 1997. We would need to consider
whether or not to go it alone in these areas in about 18 months
from now.

All of these delays, and perhaps particularly delays in the ASA programme if coupled with lack of progress on the airport, will have a debilitating effect on the business
community. There is not a lot we can do about that.

A list of non-ACP franchises and major contracts to be let before 31 December 1993 is attached (ANNEX A).
