PAPER 2: Legal Advice on the S K Tang Bequest:

2(A): MR SLACK AT THE CHARITY COMMISSION

1. Mr Slack of the Charity Commission wrote to us on 27 April. I attach a copy of his letter. He explains the legal details fully but, in summary, the points he makes are:

a. There is a lack of 'mode' for carrying into effect

Sir S K Tang's bequest, therefore a scheme needs to be made.

b. There is no trust on which to base a scheme.

c. Thus, there is a need for a Sign Manual to establish a scheme.

d. We need to raise the matter to the Attorney General's Chamber in HK to see if they agree with Mr Slack and whether a Sign Manual could be given there rather than having to gain one in the UK.

I should be grateful for your comments on the points that Mr Slack has made. Due to the delays already incurred, I am hoping to reply to him as swiftly as possible. However, I appreciate that this could be a rather complicated matter!
