DELTA CROMPTON CABLES

Thank you for the copies of Keith Melville's minute of 19 March and Martin Paynes' related minute of 23 March.

My contact in Trade Department quickly checked the position vis a vis Hong Kong legislation and is fairly confident that there is no specific legislation from which Delta Crompton Cables might benefit (HKG does of course, as a separate member of the GATT, conform to GATT directives). Regarding the locus standi of Delta Crompton Cables as a potential litigant in Hong Kong, we would I think have to take legal advice but the company.does appear to have a subsidiary here viz Delta Electrical and Engineering Hong Kong, who possibly could be used as a conduit if on this occasion the local firm are the suppliers to CLP.

As I mentioned, Mr Eggar has also written to the Governor of Hong Kong and I enclose a copy of this letter of 12 March and of Lord Wilson's reply of 19 March. If the Minister for Trade will mention that this office has indeed been consulted on this matter then we will not reply separately to Mr Eggar. Perhaps you could keep me informed on this point. Also worth bearing in mind is that Delta Crompton Cables are not the only British company bidding for CLP's next order for 11kv cables and certainly we here would have to be very careful in any lobbying we do with CLP not to jeopardise the position of Delta's British competitors.
