ELECTED LEGCO PRESIDENT AND CBF'S EXCO MEMBERSHIP: AMENDMENTS TO THE ROYAL INSTRUCTIONS AND LETTERS PATENT

1. Hong Kong have now written to let us now what progress has been made at their end. They are basically content with the draft amending instructions which were enclosed with your minute of 7 October to Mr Stone.

Hong Kong have noted that no amendment is proposed for Clause XXIV of the RI which provides that every ordinance, vote etc which creates a charge on public revenue "shall be proposed by the Governor, unless the proposal of the same shall have been expressly allowed or directed by him." They are now seeking legal advice on what, if any, amendments are necessary to preserve the Governor's right under this clause consequential to his stepping down as Legco President. would be grateful to have your advice on this matter in the meantime so that I can pass it on to Hong Kong.

Provided that this Clause XXIV has been settled in time, Hong Kong would like us to sumbit the proposed amendments to the 17 November Privy Council. We have told them that this is fairly unlikely and they are prepared to wait until the 17 December meeting instead. Please could you let me know whether this is going to be possible and also give me some indication of the lead time between the Privy Council's decision and the date when the amendments become effective. According to our telno 1485 it would be a few weeks. Is this correct?

I think it would be here realistic to aim for the Deemaer Airy Council. (paper for the November Pring Council must be with the Privy Councel office by 11 November). A lead time of 3/4 weeks would be recoled between submission the ten Priving comid enting wito force. In fact, given the Christmas
