the period of conditional practice under or pursuant the Legal Practitioners Ordinance, subject to any waiver that may be granted under the Ordinance.

Practitioners

may sit for the required Test examination (s) either before working in a Hong Kong firm or while working in the firm. Should practitioners choose to work while preparing for the Test examination(s), the time spent in a Hong Kong law firm prior to the successful completion of the Test examination(s) may, upon admission, count as part of the period of conditional practice.

Comments

This section would permit Common Law lawyers admission to the profession upon completion of from 1-4 examinations. Practical experience could serve as an alternative qualification and an exemption may be granted. A period of limited practice would be consistent with restrictions now placed on newly qualified solicitors in Hong Kong and would serve as a period of adaptation before the solicitor could practise either as a partner or a sole practitioner.
