The above rule is based upon the assumption that those entering the profession should have similar qualifications to Hong Kong trained solicitors.

This would include:

1) an LL.B. or equivalent course of study admission in a foreign jurisdiction

a period of practice which could be either articles or active practice.

The use of an alternative is suggested because of the fact that some jurisdictions do not have a requirement of service under articles.

Practitioners who have been admitted to practice in a jurisdiction the law of which is based upon the Common Law and who have completed the following:-

either immediately or recently, for a period of at least five years, have been engaged in work similar to that usually undertaken by a solicitor in Hong Kong in the course of his practice,

may be admitted upon completion of, or exemption from, examinations in the following topics:-

Accounts;

(ii) Professional Conduct;

(iii) Commercial and Company Law; and (iv) Conveyancing.

If an applicant does not meet the requirements of (1) (a) above, the Law Society may require the satisfactory completion of an examination in the relevant subject(s).

Proposed standing exemptions are given in Part B of the Guidelines.

All applicants must file with the Law Society a certificate of good standing from the jurisdiction by reference to which the applicant wishes to be assessed under the Scheme.

Upon admission, a solicitor will be issued a practising certificate subject to the condition that the solicitor shall not practise on his or her own account or in partnership for a period no less than that prescribed
