He was appointed as a District Judge on 19 June 1990. He is now on a 3-year agreement which will expire on 29.10.91. He was found medically fit on 19 June 1990 for transfer to the permanent establishment.

A copy of the medical examination board report dated 19 June 1990 is attached. His performance is satisfactory.

As a District Judge, H.H. Judge URIAR's tenure of office is governed by Article XVIA (2) of the Hong Kong Letters Fatent, which states that a Judge shall vacate his office when he attains the retiring age of 65. Therefore, the terms on which H. Judge SURMAN is appointed, whether on agreement or on the permanent establishment, do not provide for any difference in the tenure of office.

Mr. HALKES was born on 29 November 1940 in New Zealand. He was recruited as a Crown Counsel in the Legal Department on 25 February 1978 through the then Hong Kong Government Recruitment Office (Australia). A copy of appointment letter dated 19 December 1977 is attached.

Be was appointed as a Magistrate on 22 January 1981 and promoted to Principal Magistrate on 12 June 1985. He was appointed an Assistant Registrar, Supreme Court on 21 January 1987. He is now on a 3-year agreement which will expire on 22.1.93. He was found medically fit on 15 May 1990 for transfer to the permanent establishment. A copy of the medical examination board report dated 15 May 1990 is attached. His performance is satisfactory.

Mr. MEREDITH was born in England on 23 October 1934. He was recruited as a Magistrate on 31 January 1988 through the London Office. A copy of the letter of appointment dated 23 October 1987 is attached. He is currently on a 3-year agreement which will expire on January 1991. He was found medically fit on 26 May 1990 for transfer to the permanent establishment. A copy of the medical examination board report dated 26 May 1990 is attached. His performance is satisfactory.

The current arrangement for renewal of agreement of judicial officers whose tenure of office is not governed by the Letters Patent provide for the agreements to be renewed on a linked-contract basis until the age of 60, the retirement age of officers o are on the permanent establishment under the New Fension Scheme for Judicial Officers. Mr. HALIKES' and Mr. MEREDITH's proposed transfer to the permanent establishment would tie in with the spirit of the New Fension Scheme.
