(d) for a former judicial officer who retired between 1 July 1987 and 23 December 1988, within six months from 23 December 1988.
With the exception of (d) above, applications to join the NPS (JO) must be made while the officer is in service.

A judicial officer who was eligible to apply in paragraph 7 above, but who died on or after 1 July 1987 and before the expiry of the stipulated option period will be deemed to have opted for the NPS (JO) for the calculation of death benefits, if he was so eligible.

form is not received by the Registrar, Supreme Court before expiry of the option period, the officer will be deemed to have remained on the old pension scheme. An officer who has not received an acknowledgement or a copy of the completed application form within one month from the date of his application should make enquiries with the Registrar.

The Chief Justice may reject an application if he considers that approval of the application would prejudice the interests of the judicial service.

An application to join the NPS (JO), if approved, is
irrevocable.
III. Transfer to 100% pensionability
14.
Judicial officers currently on 90% pensionability may, at the same time when they apply to join, the NPS (JO), opt to
transfer to 100% pensionability with effect from a material date determined in accordance with Annex B. Those transferring to 100% pensionability will have their vacation leave earning rate reduced with effect from the same date. Details of the arrangements for transfer to 100% pension- ability are set out in Annex B.
