Hence when the New Pension Scheme for Judicial officers was introduced in December 1988, applications for transfer to permanent terms by Judges were automatically approved and those from Judicial Officers other than judges were approved if they were supported by the Judicial Service Commission.

The cut-off date of 28 March 1985 for first appointment has never been applied.

It was only after the Director queried the transfer of some officers, including

Officers close to retirement in August 1990, that the Registrar, Supreme Court agreed that officers who. apply for transfer

the permanent establishment should have at least 5 years to serve before retirement. Those appointed as Judicial Officers after reaching 50 years of age or appointed before 1.7.87 and having attained the age of 50 when they apply for transfer, should have at least 2 years to serve before retirement. These conditions

are specified in the Circular at Annex A.

Copy of CSB Circular No. 6/85 issued in 28.3.85 and CSR 121 governing the transfer of civil servants to permanent and pensionable terms are at Annex C.

This Circular was copied to the Registrar, Supreme Court in accordance with normal practice.

CSB Circular No. 6/85 stated that only agreement officers first appointed to Hong Kong before 28.3.85 are eligible to apply for transfer to permanent terms : we did not explicitly mention their eligibility to join HMOCS. However this has always been taken as This circular was issued to Heads of
