3) An officer who receives compensation under the, provisions of this paragraph shall not be eligible to receive any gratuity or compensation for loss of career under any other provision of this Scheme and it shall be a condition of the grant of any transfer and the payment of any compensa tion, under the provisions of this paragraph that any such gratuity or compensation for loss of career already paid to the officer, pursuant to paragraph 7 shall be refunded.).

~ (4) An entitled officer may intimate in writing to the Administrative Secretary that he desires a transfer to other public service and may specify in such intimation a date on which he wishes to relinquish his duties if transfer is not effected.

(5) Every such intimation shall be submitted to the Governor who, if the officer concerned has specified a date on which he wishes to relinquish his duties shall having regard to the exigencies of the service and the wishes of the officer, appoint a date on which such officer shall relinquish his duties, and thereupon such officer shall relinquish all duties on such date or so soon thereafter as may conveniently be arranged and proceed on leave; and on the termination of such leave unless a ̈transfer has hitherto been effected, the officer shall retire and be deemed to have retired under the provisions of paragraph 2 for the purposes of this Scheme :

· Provided that the Governor shall not appoint a date subsequent to the date of transfer of powers unless the officer consents or has consented in such intimation.

6.—(1) If a pension or compensation for loss of career shall be granted under paragraphs 3 and 4 to an entitled officer on his retirement, or if an entitled officer or an overseas officer is transferred or reverts to other public service, such entitled officer or overseas officer shall also be eligible for the following benefits, namely-

(a) a disturbance grant, which shall consist of a sum equal to one-third: of the officer's last drawn annual pensionable emoluments in the Colony; prior to his retirement, or his transfer or reversion to other public service, as the case may be,

; (b) additional leave for three months on full pensionable emoluments and allowances, together with such further period (if any) of leave as A. aforesaid as shall, with any leave that may have been earned by the” 2 officer, bring the period of his total leave pending retirement or transfer? or reversion to other public service up to a minimum of six months:4 Provided that additional leave shall not be granted—

(i) to an officer whose total entitlement of earned leave exceeds twelve,

months,

(ii) to the extent that such additional leave would cause an officer's

total entitlement of leave to exceed twelve months,

: (iii) to an officer whose total entitlement of carned leave will extend

beyond his fifty-fifth birthday, or, in the case of a judge of the Supreme, 7 Court or other officer whose retiring age is sixty or sixty-two, his

sixtieth or sixty-second birthday, as the case may be,

(iv) to the extent that such additional leave would cause an officer's 2. total entitlement of»leave to extend beyond his fifty-fifth birthday, or, in the case of a judge' of the Supreme Court or other officer whose retiring age is sixty or sixty-two, his sixtieth or sixty-second birthday; as the case may be.

(2) Notwithstanding anything in the foregoing provisions of this paragraph--- voqeagadza

(a) no disturbance grant nor additional leave shall be granted to an entitled officer or an overseas officer except to such extent as may approved by the Governor; and,
