date, whereupon such officer shall on the appointed date or so soon thereafter as may conveniently be arranged, relinquish all duues and proceed on leave prior to retirement and shall retire on the expiry of such leave:
Provided that the Governor-
(a) shall not withhold permission for an officer to retire unless proceed- ings for the dismissal of the officer, are being taken or are about to be taken, and'
(b) shall not appoint a date subsequent to the date of transfer of power
without the consent of such officer, and--
Provided further that any date so appointed shall not, as far as is practicable, be less than two months after the date on which the officer is informed thereof, unless the appointment of an earlier date shall be acceptable to the officer concerned.
(3) The Governor may require an entitled officer to retire and in such a case shall appoint a date after the operative date and before the date of transfer of powers on which such officer shall relinquish his duties and shall cause such officer to be informed in writing of his intended retirement aud such date, whereupon such officer shall on the appointed date or so soon thereafter as may conveniently be arranged relinquish his duties and proceed on leave prior to retirement and shall retire on the expiry of such
Provided that an officer required to retire under the provisions of this sub-paragraph_shall be given at least two months' notice of his intended retirement and the date on which he shall be expected to relinquish his duties unless a shorter period of notice shall be acceptable to the officer concerned.
Pension of Entitled Officer
3-(1) On the retirement of an entitled officer under the provisions of paragraph 2, he shall be eligible for such pensión as may, under the Pensions Law as modified by this Sobeme, be granted to an officer on his retirement.
(2) Notwithstanding any provision of the Pensions Law to the contrary such entitled officer shall be eligible for such peasion whether or not-
(a) he retires after attaining any age specified in the Pensions Law as
qualifying for the grant of a pension ; or
(b) he has been in qualifying service for such period as is required by the Pensions Law to render him eligible for the grant of a pension; or (c) being an officer on probation he has been confirmed in a pensionable
office.
".
(3) Notwithstanding any provision of the Pensions Laws to the contrary an entitled officer whose annual pension does not exceed three hundred and fifty pounds may be paid at his option in lieu of such pension a gratuity "equal to the amount of the annual pension
A to which he is entitled multiplied by the factor set out in Table in the First Appendix to this Scheme appropriate to his age in years and completed mouths on the date of his retirement.

(4) An entitled officer whose annual pension exceeds three hundred and fifty pounds may be paid at his option in lieu thereof an annual pension reduced by not more than one quarter or three hundred and fifty pounds whichever is the greater together with a gratuity equal to the amount of the reduction so made in the annual pension multiplied by the factor
set out in Table "A" in the First Appendix to this Scheme appropriate 121
