Elementary Education Law" means the Elementary Education Law of the Colony as in force at the date of this Order and includes any Regulations made under that Law and in force on that date

Estate Duty Law means the Estate Duty Law of the Colony the date of transfer of powers *means such date as may be notified by the Governor in the Official Gazette of the Colony as the date on which an independent Republic is to be established in Cyprus;
entitled officer" means an overseas officer who on the operative date is serving in a public office in the Colony or in the opinion of the Governor would be so serving but for his temporary transfer or secondment to other public service and includes an overseas officer serving on probation who in the opinion of the Governor had a reason- able prospect of appointment to the pensionable establishment, but does not include an overseas officer serving on temporary transfer for second- ment or serving on contract or agreement

(2) Expressions used in this Scheme shall, unless the contrary intention appears, have the meaning ascribed to such expressions in the Pensions .. Law and any Regulations made thereunder."
(3) For the purposes of this Scheme, the decision of a Secretary of State as to whether or not a person is an entitled officer shall be final
Premature Retirement
2-(1) An entitled officer may make application in writing before, on, or after the operative date, to the Administrative Secretary for permission to retire, and shall specify in such application a date after the operative date on which he desires to relinquish his duties preparatory to his retirement.
(2) Every application made pursuant to sub-paragraph (1) of this para- graph shall be referred to the Governor who may grant an officer making such application permission to retire and shall in such a case, having regard to the exigencies of the service and the wishes of such officer, appoint a date after the operative date on which such officer shall relinquish his duties, and shall cause such officer to be informed of the grant of permission and such-
