(2) The relevant Table:
(a) for officers to whom the Pensions Ordinance applies, is
Table I;
(b) for officers to whom the Pension Benefits Ordinance
applies, is Table II;
(c) for judges, or the Registrar or a deputy Registrar of the
Supreme Court, whose normal retirement age is 65, is Table III;
(d) for judges whose normal retirement age is 60, is
Table II.
(3) The notional maximum sum would be calculated as follows;
(a) identify the entitled officer's salary point for the
substantive grade held by him on 30 June 1997 and then determine the salary appropriate to that salary point of that grade at 1 January 1992 ("the notional 1992 salary");
(b) multipy the notional 1992 salary by the appropriate
increase factor under the United Kingdom Pensions Increase (Review) Order for 1997 (which will have effect from 1 April 1997) as though the notional 1992 salary were a pension begining in April 1992; this would produce a "notional 1997 salary", based on the movement of the United Kingdom Retail Price Index from 1992 to 1997;
(c) multiply the notional 1997 salary by the appropriate
factor taken from the relevant Table, which will produce a sum in HK dollars;
(d) convert the sum arrived at from sub-paragraph (c) into
sterling using the average rate of exchange between the HK dollar and the £ sterling during 1991, ie £1 = HK$13,7609; the resulting sum in sterling is the notional maximum sum.
PAYMENTS OF BENEFITS
8. (1) A payment of [one fifth] of the notional maximum sum will be paid to every entitled officer as soon as possible after the 30 June 1997.
(2) A provisional payment schedule for equal annual instalments of the balance of the notional maximum sum will be prepared for each entitled officer which will set out the number of instalments applicable to that officer, the dates on which they are due and the amount of each instalment. number of such annual instalments applicable to an entitled officer will be [eight] or the difference between the age of
