Clause 24. SPARE PARTS, as amended, is hereby amended as follows:

Subclause 24.01 is amended by inserting after the phrase "spare parts and ground support equipment" in the first sentence of the first paragraph the phrase "for the Helicopters described in the Specification".

Subclause 24.01 is further amended by inserting after the words "Schedule 2, Paragraph B" in the second and third sentences of the first paragraph the words "subparagraphs 1 and 2".

Subclause 24.01 as amended by Amendment No. 1 dated April 23, 1990, is further amended by inserting after the phrase "extended service policy to cover the initial spare parts provisioning order" in the first sentence of the second paragraph the phrase "for spare parts for the Helicopters described in the Specification as".

(d) Add the following two paragraphs to Subclause 24.01:

"The Government and the Seller agree that an amount for spare parts and ground support equipment for the S-70A-27 Utility Helicopters described in the S-70A-27 Specification is included in the S-70A-27 Helicopter Contract Price. A detailed listing of part numbers and quantities of the initial provisioning of spare parts and ground support equipment for S-70A-27 Utility Helicopter be delivered is presented in Exhibit J, which Exhibit is attached hereto and made

a part hereof. Such provisioning of spare parts and ground support equipment will be delivered to the Government FOB Seller's Facility in accordance with the Delivery Schedule contained in Schedule 2 Paragraph B subparagraph 3. Following delivery, Seller will consolidate such items 83 practical and make arrangements for shipment via air-freight to the Government's designated site in Hong Kong. Upon shipment Seller will invoice the Government at the unit price for each item shipped up five percent (53) charge for chipping, handling and LIMANCE. The Government shall remit payment to Seller upon receipt of Seller's invoice.

Seller agrees to provide the Government with an extended service policy ("Service Policy") to cover the provisioning of airframe spare parts for the S-70A-27 Utility Helicopters as specified in Exhibit J. Seller's liability and the Government's remedy under said Service Policy are limited to repair or replacement, at Seller's election, of such spare parts returned to Seller which are shown to Seller's reasonable satisfaction to have been defective in material or manufacture at the time of delivery provided that written notice of the defect shall have been given by the Government to Seller within two (2) years after the date of expiration of the warranty which covers said spare part pursuant to Section 16. WARRANTY of the Agreement, and in no event later than sixty (60) days after the Government's discovery of a defect within the warranty period."
