I attach a letter and supporting documents received today from the District Lands Office regarding the draft conditions applicable to the grant of the Colvin House site for the Consulate-General building. The two site plans enclosed with the letter cannot be faxed and these are being sent to you today by special courier (DHL) and should be with you mid-week. I have not copied the papers to Swire Properties Projects Limited since it is not clear from the papers I have seen that they have received a brief from you on this matter.
It would seem to me that the main problem areas identified in your submission of 15 November remain. In addition to the four you identified then, Special Condition 8 could pose a problem. The tree surveyor has identified 2 mature trees (6 metres and 5 metres in height) of a rare and protected species (Litsea Cubeba) on the slope between Colvin House and Regent On The Park. This particularly rare tree does not, according to Mr Williams, usually survive transplantation. There are additionally over 30 trees on site with a high amenity value. You will see that Mr Williams has suggested an early meeting on site to discuss the tree issue; doubtless this is something you will wish to put to Swire Properties Projects Limited sooner rather than later.
Could I leave it to you please to send copies of the enclosures to this letter to HKD and anyone else who may have an interest at this stage. I have told Mr Williams that I am consulting you on this matter and that I will be in touch with him as soon as I receive your reply.
