MUTUAL ASSISTANCE IN DRUG TRAFFICKING CASES

1.

In order to establish arrangements between the United Kingdom and Hong Kong whereby each will provide to the other mutual assistance, the extent possible within their respective laws, in the restraint a. the confiscation of the proceeds of drug trafficking, I have the honour to propose that the United Kingdom and Hong Kong make designation orders in respect of each other under the provisions of their respective anti-drug trafficking legislation.

I have the honour to confirm that the United Kingdom is willing designate Hong Kong under the Drug Trafficking offences Act 1986 and the Criminal Justice (Scotland) Act 1987 thereby giving access to th powers created by those Acts for the enforcement of external orders and the restraint of property in connection with proceedings outside the United Kingdom. I respectfully request that you confirm that Hc Kong intends to designate the United Kingdom under the Drug Trafficking (Recovery of Proceeds) Ordinance 1989 and will afford th United Kingdom access to the powers created by that ordinance for th enforcement of external orders and restraint of property in connecti with proceedings outside Hong Kong.

3. I have the honour to propose that this arrangement should have effect in relation to Northern Ireland when my Government informs yours in writing that the requisite legislation is in place. Thereupon my Government will designate Hong Kong under that legislation, giving Hong Kong access to the powers created by that legislation for the enforcement of external orders and the restraint of property in connection with proceedings outside the United Kingdom.

4. I also have the honour to propose that this arrangement will hav effect in relation to the Isle of Man, Jersey and Guernsey, when my Government informs yours that the Governments of the Isle of Man,
