Commissioner for an official explanation and complained about the abuse of power of the police in handling the matter. But the Police Commander Mr. Lee Qang Ha, did not recieve nor reply to the demonstrators. As the demonstrators proceeding, someone discovered the group being photographed by a suspicious man. According to the students, they had seen that man several times before in different protests. They had long suspected that man as someone from the police since he always pictured close-ups for every demonstrator which was different from a photographer's practice. The students then asked his identity, could not produce at first and did not say that he was a journalist. When pressed later, he claimed himself to be а photographer for a wedding studio. Later as the group went back to the Legco after the proceeding, this man appeared again to take pictures again. Students questioned his identity again. He quickly slipped into the barred off area at the carpark with the silent consent of the police. Students then claimed that the man had connection with the police otherwise he could not enter the

restricted carpark.

In the past, demonstrators could enter the Jackson Road carpark to petition to the Legco members as they walked into the Legco building. Since October 1990, more and more restrictions were put up. Railings and police cordoned off the whole carpark to forbid demonstrators from entering. LEGAL BASIS FOR DECLARING THE LEGCO CARPARK RESTRICTED AREA According to the Legislative (Power and Privilege) Ordinance, Legco carpark is not closed to public unless, 1) An adminstrative Notice issued from the Governor 2)A resolution was passed in the Legco meeting. None of the above condition was met, the Legco carpark was

made" a restricted area, without any notice or warning to the public. Legislative Ordinance enpowers the security to bar the public from entering its area only when such individual(s) misbehave or disturb public order.

The students and demonstrators questioned the legal basis of Legco and the police to make the Jackson Road carpark restricted area, undermining freedom to express and demonstrate. They questioned the authority and discretion power of the police is SO great that the even under no concrete evidence of demonstrators constituting a breach of peace, could they use force or any means to arrest or remove the demonstrators. The fact that nobody from the Government, the Legco or the Police Force come out to give an official explanation to this policy respond to demonstrators'questions and protest at all was more unacceptable to the demonstrators.
