They were stopped approaching the NCNA by the police at the cross road at least 100 metres away.

1) SECTION 4 subsection (29) USE OF LOUD SPEAKERS OR MEGAPHONES

SUBJECT TO COMMISSIONER OF POLIECE 'S PERMIT

Five political activists were prosecuted for using loudhailers in

public places in a public fund-raising without prior permission in May 1990. It should be noted that the ordinance has not been used for prosecution for 17 years. This case is obviously a selective prosecution.

Unionist Mr. Lee Cheuk Yan complained to a visiting delegation of the International Commission of Jurists that he had been warned by the police about 20 times in the past year for the use of a loudhailer in public. (SCMP 6.27.91)

2.12.1991, 6 students had an overnight sit-in outside NCNA. Police threatened arrest if students did not leave. prosecution, this time under the charge of "dumping in public places" was threatened to make the students leave. For dumping, police were referring to the protest placards and banners carried by students.

Commissioner of Police Mr. Lee Kwan Ha quoted section to justify the incident of police restricting Legislative Council carpark from demonstrators' entry petition to the Legco members as they go in for meetings every Wednesday. And also to justify the carrying away of 9 students by force from the Legco carpark entry.
