The prisoners did not set out deliberately to kill thə

deceased, for whom they were in fact not searching on that occasion.

They had however deliberately armed themselves with knives,

no doubt in case of trouble, and when the fight started did not

hesitate to use them in circumstances which do not suggest any

question of self-defence. The number of wounds sustained by the

deceased point to the attack being preased home with determination.

Only WONG Wing-tim and CHAN Kan-cheung were identified as

having weapons. (In WONG's case he was identified as holding a

paper bag which contained a knife.) But evidence was given that all

four petitioners were seen making thrusting movements with their arms

towards the deceased; even if they had no weapons their guilt is

nonetheless established since, knowing they were part of an armed

band, they continued with an attack on the deceased in which weapons

were being used.

WONG Wing-tin is believed to have been second in command of

a prominent Kowloon Triad Society.
