Only WONG Wing-tim of the four petitioners gave evidence to the

effect that he thought the paper bag handed to him when he asked for

the "account book" did in fact contain an account book, and that it

was with this that he tried to ward of the attack by the deceased.

WONG Wing-tim', a evidence was relied on by his co-accused

who did not give evidence. The gist of their defence was that they were

not armed, nor were they looking for trouble. WONG Wing-tim said that he

was attacked not only by the deceased but also by his associates with

whom he was having dinner. This raised the question both of self

defence and of ovocation.

On the matter ut provocation, a prosecution witness told

the court that over a puth before the date of the murder WONG Wing-tim

had said something to the effect that the deceased deserved to be hit

for not paying his debts. This evidence might suggest that Wong already

then had feelings of hoality towards the deceased.
