(b)(iii) Mortgages
5.35.
It is clear from the comments we received on
mortgages that a very comprehensive and detailed study
in this area is needed before any changes to existing
procedures or legislation can be embarked upon. This is
a comparatively specialised area and without the benefit
of a detailed study we found it difficult to agree or to
disagree with proposals for change.
5.36. The topic of liens and mortgages and other
related subjects is presently under review by both the
IMO Legal Committee and the UNCTAD Working Group on
International Shipping Legislation. The Working Party
(as proposed in Chapter 4) might make a detailed study
to ascertain what improvements in the existing system
could be made. It is suggested that this subject matter
deserves some priority, taking into account any international developments.
