On 5
January, the British side handed over a speaking
note to the Chinese side and informed us that the UK
intends to include Hong Kong its ratification of

the Haque Convention on Laws Applicable to Trusts and on
their recognition or to extend the Convention to Hong Kong
subsequently. This would create new international rights and
obligation for Hong Kong and the British side think it would
be appropriate for the Convention to continue to be applied
to the Hong Kong SAR after 1997. The British side intend to
make the reservation on Article 16, para (2) and the
declaration permitted by Article 20, para (1), which would
also extend to Hong Kong. The British side therefore come
to consult the views of the Chinese side according to the
agreed guidelines for consultation. The Chinese side asked
the British side several questions on 27 January, to which
answers by the British side were given to us on 2
February. Following that, experts on both sides
