Convention on the Conflicts of Laws
relating to the form of Testamentary Dispositions.
(Hague 1961)
This
Convention establishes common rules on the
selection of the appropriate law to determine the validity
of a testamentary disposition. The Contracting Parties,
unless they make certain specified reservations, agree to
accept the validity of the form taken by any testamentary
disposition, if its form complies with the internal law
(i)
(ii)
(iii)
of the place where it was made or,
of the country of the testator's nationality, or
the place of his domicile or habitual residence
at the time he made it or at the time of his
death or,
So far as
immovable property is concerned, the
place where it is situated.
2.
If a national law consists of a non-unified
system, the law to be applied shall be determined by the
applicable in that system; and, failing any such rules,
rules
by the law within that system that the testator had the
most real connection with (Article 1).
