a resolution on the capital, calendar, national anthem and flag of the PRC, a resolution on the national day, an order on the national emblem, a declaration on the territorial sea, the Nationality Law and the Regulations concerning Diplomatic Privileges and Immunities [33]
The power to
add further laws is ordinarily confined to laws relating to defence, foreign affairs and other matters outside the limits of the autonomy of the SAR (and before exercising the power, the Standing Committee is required to consult the Basic Law Committee) but, as has been discussed above, where the Standing Committee determines that a state of war or emergency exists, the CPG may also "apply the relevant national laws in the Region".

19. One consequence - and it was a deliberate one of the restriction of national laws to the list in an Annex to the Basic Law was that the PRC Criminal Law would not apply in the SAR. This raised the question of what provision should be made for offences against the state and, in effect, to replace those laws relating to treason and sedition which are presently part of Hong Kong law. The April 1988 text provided that the SAR itself should prohibit by law" any act designed to undermine national unity or subvert the Central People's Government" a provision which could well be satisfied by modifications to the existing law on lines not dissimilar to those adopted in cases of state succession within the Commonwealth.
