MEMORANDUM FOR EXECUTIVE COUNCIL

The Official Secrets Act, 1989

Section 2 of the Official Secrets Act 1911 is an

ineffective means of providing protection in respect of the

communication of confidential official information.

Its

replacement by the Official Secrets Act 1989 needs to be

considered.

RECOMMENDATION AND ADVICE SOUGHT

2.

It is recommended that Her Majesty's Government

(HMG) be asked to extend the Official Secrets Act, 1989 to

Hong Kong by Order in Council.

3.

Members will be asked to advise whether this

recommendation should be approved.
