Where officers express a wish to remain in the Civil Service, every effort will be made to redeploy them to other departments at comparable ranks in other grades. Where these efforts fail, the officers concerned will be required to take early retirement as a result of the abolition of their present offices. Officers not wishing to remain in the Civil Service would take early retirement on abolition of office.

Those who retire would immediately receive their pension benefits together with an enhanced element as provided for by law. In addition, it is proposed that they be granted an ex-gratia payment equivalent to six times final monthly salary to compensate for loss of fringe benefits.

This is in line with arrangements made in previous disestablishment exercises. Staff who retire will be free to apply for positions in RTHKC in competition with other candidates from outside. Actual payment of monthly pension to retired departmental grade officers during the period of any employment of them by the corporation, however, would be suspended.

(b) Agreement officers (Total: 49)

These are civil servants employed on agreement terms of service for a fixed duration. They are eligible for the payment of a service gratuity at the end of each agreement period and are not eligible for pension benefits.

These officers will be given the option of mutually resolving their agreement with their accrued benefits paid on a pro rata basis. Alternatively, their agreement would be determined in accordance with the conditions stipulated in their contract of employment. As a general rule, the Government does not grant ex-gratia payments in these circumstances.
