rejecting any appeal made against any findings of

review conducted under section 46(1) or

recommendations submitted under section 46 (2) or

ordering the Broadcasting Authority to withdraw the

findings or recommendations or amend the findings or

recommendations in such manner as may be specified by

the Governor in Council;

confirming, varying or reversing any direction or

decision of the Broadcasting Authority; or

amending any Code of Practice to the extent that it

is inconsistent with his determination.

46.

Performance review

(1) The Broadcasting Authority shall, once every 5 years after

the date of the coming into operation of this Ordinance, conduct a

review of the performance of the Corporation in carrying out its

objects for the purpose of making recommendations concerning the

future activities of the Corporation.

(2) For the purpose of any review conducted under this section

the Broadcasting Authority may -

(a) consider information and matter received from any

source;

(b) hold hearings in public.

(3) Upon completion of a review under this section the

Broadcasting Authority shall

(a) submit its findings and recommendations concerning

the future activities of the Corporation to the

Governor in Council; and
