the finding of any review conducted under section
46(1) or any recommendation submitted under section
46(3);
any direction of the Broadcasting Authority given
under section 41;
any decision of the Broadcasting Authority in the
exercise of any discretion vested in it by or under
the Broadcasting Authority Ordinance (Cap. 391), or
the Television Ordinance (Cap. 52); or
anything contained in any relevant Code of Practice
or direction issued by the Broadcasting Authority,
it may within 30 days of receipt of the letter of admonition or copy
of the findings and recommendations or the notification to it of the
direction or decision of the Broadcasting Authority or within 30
days of the date of issue of the Code of Practice, as the case may
be, appeal by way of petition to the Governor in Council.
(2) An appeal made under this section shall not affect the
operation of the direction, decision or Code of Practice appealed
against prior to the determination of the appeal.
(3) The Governor in Council may determine an appeal lodged
under this section by
(a)
confirming the letter of admonition issued under
section 43 (1) or ordering the Broadcasting Authority
to withdraw that letter or amend the letter in such
manner and publish the withdrawal or the particulars
of the amendments in such manner as may be specified
by the Governor in Council;
