(2) At any time before the appointed day the Financial

Secretary and the Corporation may agree in writing that subsection

(1) shall not have effect in relation to any property, rights,

privileges, liabilities or contracts specified in the agreement and

subsection (1) shall not have effect in relation thereto accordingly.

Subsection (1) shall not have effect in relation to

(a) the terms of employment of any person as a public

officer except to the extent that his contract of

employment as a public officer specifically provides

for the assumption by the Corporation of rights,

obligations and interests under the contract;

immovable property or any contract for the sale,

lease or other disposition of immovable property;

the Technical Services Agreement made on 21 December

1987 between the Government and Hong Kong Telecom

If the Financial Secretary or the Corporation represents

to the Governor in Council before the appointed day that they have

failed to reach agreement under subsection (2) in relation to any

property, right, privilege, liability or contract and that agreement

is unlikely to be reached, the Governor in Council may, whether

before or after the appointed day, give a direction determining the

matter including a direction that subsection (1) shall not have

effect in relation to any such property, right, privilege, liability

or contract; and where it is so directed that subsection (1) shall

not have effect in relation to any property, right, privilege,

liability or contract, subsection (1) shall not have effect in

relation thereto accordingly.
