Control of Interference

9.1 The apparatus comprised in the stations shall be so designed, constructed, maintained and operated that the use of the stations does not cause any harmful interference to any telecommunication service or apparatus operating within or outside Hong Kong.

9.2

The stations shall be fitted with devices to ensure immediate cessation of its radio emissions whenever required in extraordinary circumstances by the Authority for the purpose of avoiding harmful interference to other telecommunication services or

apparatus.

10.

Limitation on Service

10.1 The uplink station shall be used only for the purposes of transmitting the Service to the AsiaSat-1 satellite and, subject to Condition 13, to such other satellites as may in future be required for the distribution of the Service.

10.2 The downlink station shall be used only for the purposes of receiving satellite programming and other material required for the Service.

10.3

Nothing in this Licence shall be construed as authorising the Licensee to offer any service which infringes any exclusive telecommunication rights granted to provide telecommunication services under Hong Kong law which exist at the date of grant of this Licence.

11.

Control & Operation

11.1 The stations shall be operated only by the Licensee

or its authorised agents.

11.2 Where the stations are operated by the authorised agents of the Licensee, the Licensee shall procure compliance with the conditions of this Licence by its agents and any breach of these conditions by an agent shall be deemed to be a breach by the Licensee.

11.3

Notwithstanding the provisions of Conditions 1 and 11.1, the Licensee may use and operate equipment which is owned by a third party for the purposes of the service.
