forces. It is intended to ensure that people recruited to

sensitive trades in the forces have a sufficient connection

with the UK grown. It is also intended to ensure that

realistic security checks against reliable records can be made into an applicant's character.

4. However, in some cases applicants are eligible for a waiver of this rule. For example, if an applicant has been resident outside the UK because of his or her parents' UK

Government service, or if residence in the UK in 12 consecutive months in the five years preceeding application can be proved. The flow chart at Annex D sets this out.

In fact, Derek Broomfield's case was satisfactorily resolved when it was discovered that he had spent 12 consecutive months in the UK in the five years previous to his application. At the same time, because of the representations made by the Association and/Neville Trotter, MP, service with the Royal Hong Kong Police Force was recognised as having sufficient Crown connections to make an applicant such as Derek Broomfield eligible for a waiver of the residency requirements.

However, this change does not address the central point Mr Braithwaite makes in his letter. The Superintendent's Association consider that because of the residency requirement, HMOCS members' children are being discriminated against because of their fathers' service with the Hong Kong Government. They point out that membership of HMOCS does in fact constitute "Crown service" and therefore should make HMOCS members' children eligible for employment in the armed services before and after 1997. They have asked us for clarification of this.
