We spoke about your minute of 12 September. I understand the phrase "related organisation" comes from the letters from the Secretary to the Enquiry to the PUS and to Roger Bone. The term has no specialised meaning and presumably it would be necessary to look at the terms of reference of the Enquiry to understand what it means. I would be extremely surprised if those terms of reference did not include the activities of all BCCI subsidiaries including BCC (HK). (Mr Soper, ERD, is checking the terms of reference.) The term "related organisation" must, therefore, be taken to include BCC (HK). Accordingly, we should endeavour to provide the Bingham Enquiry with information on our files relating to BCC (HK).

I understand that the Report by the Commissioner of Banking to the Governor attached to your minute has been published in Hong Kong and that there would be no problem in making it available to the Enquiry. I should perhaps add that with regard to other documents of the Hong Kong Government on our files, these should not be made available to the Enquiry without the agreement of that Government. The same goes for Government documents of other DTs.
