When Mr and Mrs Leung arrived at Heathrow Airport on 10 June, they had been away from this country since 1 September 1988. My-Leung indicated to the Immigration Officer that he would be h for only a brief period before returning to his business interests in Trinidad. As it appeared that he was not seeking admission for settlement, the Immigration Officer admitted Mr Leung as a visitor. Indeed, on 2 July Mr Leung retrieved his passport from the Immigration and Nationality Department to enable him to travel overseas. I note also from the enclosed letter that Mr Leung's business interests are in Trinidad and so he may well not have remained ordinarily resident in the United Kingdom during his absences from this country.

Mr Leung's application for his previous indefinite leave to be restored lapsed when he withdrew his passport and if he wishes it to be reconsidered he should apply for entry clearance to the Entry Clearance Officer in Trinidad. Mrs Leung's application will however now be considered and I hope to be able to let her have a decision as soon as our enquiries are completed and the application considered in the light of the information we receive. Should her application be refused, then she will of course have a right of appeal to an independent adjudicator.
