Won't the scheme rule out all senior civil servants from becoming eligible for appointment to senior posts in the SARG under the Basic Law?

It has always been clear from the Joint Declaration that certain top posts in the SARG would be reserved for Chinese nationals. It is clear therefore that people who are ambitious and wish to serve in these top jobs will have to make a decision whether to apply under the scheme. If they do, it will limit the level they can attain in the SARG.

If the Chinese refuse to recognise these passports, won't all the people covered come here?

The Joint Declaration makes clear that residents of the Hong Kong SAR may use 'travel documents issued by the Hong Kong SARG, or by other component authorities of the People's Republic of China, or of other states'. The Government would expect the Chinese to honour their commitments under the Joint Declaration.
