Is the scheme not elitist and divisive?

Certainly not. It will cover a wide range of activities. It is selective in that it aims to capture the best of those identified by Hong Kong as being 'key' to the territory's future prosperity and stability. Most of the places are expected to go to the private sector.

Why restrict eligibility to those settled in Hong Kong?

Those no longer settled in Hong Kong cannot be said to require an assurance in order to remain there. The scheme is aimed at those who continue to see their future in Hong Kong.

Those holding another citizenship already have the assurance of somewhere to go if they think it necessary to leave Hong Kong. It is more sensible to concentrate the places on those who have no such alternative.

Why is the scheme not open to everyone?

While many working in Hong Kong are important, not everyone has a ‘key' role. The scheme is limited and must focus as narrowly as possible on those who are judged to be the most vital to Hong Kong's continuing prosperity and stability.

Why use a points system?

It is judged to be the fairest and most effective way of selecting the right candidates. It is a tried and tested method used by Canada and Australia.

Why is a spouse acquired after the head of household ceases to reside in Hong Kong not eligible for British citizenship?

Once a beneficiary under the scheme ceases to reside in Hong Kong he loses any claim to benefit further from the special provisions of the Bill. His spouse then falls under the normal nationality provisions which do not allow a spouse to acquire British citizenship by virtue of the marriage.

Why does the Bill depart from the existing provisions of the British Nationality Act by granting citizenship to spouses by virtue of marriage?

If this were not the case, key personnel in Hong Kong would be tempted to leave the territory in order to secure an assurance for their wives and families.
