The Home Office have now written with their views on the Gibraltar proposals (a copy of their letter is attached). You will see that they suspect this scheme could prove embarrassing for the forthcoming Order-in-Council if it were made public as it would be seen as a way of breaching the 50,000 ceiling under the British Nationality (Hong Kong) Act 1990. I should be grateful for your comments on the Home Office letter, (I'm not sure what is the rationale for the suggestion in para 6 that HK immigrants could only take up residence if Gibraltar were to establish a special form of non-resident settled status. This does not seem logical. Also reference in the last sentence of para 6 to the exercise of the Governor's discretion seems at variance with para 5). Meanwhile we have substituted a less encouraging line to take for Mr Garel-Jones' visit to Gibraltar.
