(2) Anyone who is arrested shall be informed, at the time of arrest, of the reasons for his arrest and shall be promptly informed of any charges against him.

(3) Anyone arrested or detained on a criminal charge shall be brought promptly before a judge or other officer authorized by law to exercise judicial power and shall be entitled to trial within a reasonable time or to release. It shall not be the general rule that persons awaiting trial shall be detained in custody, but release may be subject to guarantees to appear for trial, at any other stage of the judicial proceedings, and, should occasion arise, for execution of the judgment.

(4) Anyone who is deprived of his liberty by arrest or detention shall be entitled to take proceedings before a court, in order that that court may decide without delay on the lawfulness of his detention and order his release if the detention is not lawful.

(5) Anyone who has been the victim of unlawful arrest or detention shall have an enforceable right to compensation.

(二) 任何被逮捕的人,在被逮捕時應被告知逮捕他的理由,並應被迅速告知對他 提出的任何指控。

(三)任何因刑事指控被逮捕或拘禁的人,應被迅速帶見審判官或其他經法律授權 行使司法權力的官員,並有權在合理的時間內受審判或被釋放。等候審判的人受監禁 不應作為一般規則,但可規定釋放時應保證在司法程序的任何其他階段出席審判,並 在必要時報到聽候執行判決。

(四)任何因逮捕或拘禁被剝奪自由的人,有資格向法庭提起訴訟,以便法庭能不 拖延地決定拘禁他是否合法以及如果拘禁不合法時命令予以釋放。 (五)任何遭受非法逮捕或拘禁的受害者,有得到賠償的權利。

Article 6

Rights of persons deprived of their liberty

(1) All persons deprived of their liberty shall be treated with humanity. and with respect for the inherent dignity of the human person.

(2) (4) Accused persons shall, save in exceptional circumstances, be segregated from convicted persons and shall be subject to separate treatment appropriate to their status as unconvicted persons.

(b) Accused juvenile persons shall be separated from adults and

brought as speedily as possible for adjudication.

(3) The penitentiary system shall comprise treatment of prisoners the essential aim of which shall be their reformation and social rehabilitation. Juvenile offenders shall be segregated from adults and be accorded treatment appropriate to their age and legal status.

被剝奪自由的人的權利

一)所有被剝奪自由的人應給予人道及尊重其固有的人格尊嚴的待遇。

(二)(甲)除特殊情況外,被控告的人應與被判罪的人隔離開,並應給予適合於未

判罪者身份的分別待遇;

(乙)被控告的少年應與成年人分隔開,並應盡速予以判決。

(三)監獄制度應包括以爭取囚犯改造和社會復原為基本目的的待遇。少年罪犯應 與成年人隔離開,並應給予適合其年齡及法律地位的待遇。

第七條

不得因違約而被監禁

No one shall be imprisoned merely on the ground of inability to fulfil a contractual obligation.

任何人不得僅僅由於無力履行約定義務而被監禁。
