According to the Chinese memorandum attached to the JD, all Hong Kong Chinese compatriots, regardless of whether they hold BDTC passports or not, are Chinese nationals. These Chinese nationals shall not enjoy British consular protection while in the HKSAR and in other parts of China.

China will resume sovereignty over Hong Kong after 1997. The CNL should naturally be applied to Hong Kong. Under that law, those Hong Kong people who wish to obtain foreign nationality and yet wish to continue to stay in Hong Kong must renounce their Chinese nationality by completing application formalities. In the mainland, the organisations which handle nationality applications are local municipal and county public security bureaus. Their counterparts in foreign countries are various Chinese diplomatic representations and consular offices.
China is still considering which organisation should handle nationality applications in Hong Kong.

Under the UK Nationality Package, Hong Kong people can obtain British citizenship without settlement in the UK and without applying to the relevant Chinese authorities for renunciation of Chinese nationality. such circumstances, the Chinese Government can, in accordance with its nationality law, refuse to recognise the British nationality of such people. Such people cannot therefore enjoy British consular protection. Nevertheless, they will be regarded as foreign nationals if they have applied to renounce their Chinese nationality and if their applications are approved. While in
in Hong Kong, such persons, however, can no longer enjoy the same rights as those of Chinese nationals. The UK Nationality
Package has muddled up the question of the nationality of Hong Kong residents which has already been resolved in the context of resolving the question of Hong Kong. It is for consideration how great the effect the Package has in promoting stability.
