The Chinese MFA spokesman has recently issued a strongly worded statement commenting on the UK Nationality Package. This is the second statement made by the MFA within two months and is worth the attention of the Hong Kong people.

The implementation of the UK Nationality Package lacks legal basis it violates both Chinese laws and the Sino-British Joint Declaration.

According to Article 3 of the Chinese Nationality Law promulgated in 1980, the PRC does not recognise dual nationality. This means that Chinese nationals cannot at the same time possess two nationalities and cannot at the same time enjoy the right to consular protection of more than one country.

Article 9 of the CNL states that Chinese nationals who have settled abroad, and who have been naturalised there or have acquired foreign nationality of their own free will, will lose their Chinese nationality automatically. This article is applicable to those Chinese nationals who have settled abroad. As for those Chinese nationals still residing in China but who wish to change their nationality status, Article 14 states that the acquisition, renunciation and restoration of Chinese nationality, with the exception of cases provided for in Article 9, shall go through the formalities of application.
