satifactory supplementary information is provided or, as a last resort, there is a revocation remedy if the Governor feels that the UK would be in breach of its international obligations in respect of the activities in outer space of a non-governmental body for which it was responsible.
Condition 8.1
We accept that the insurance condition is one imposed by the Governor but do not believe there is a vires problem in the Governor stipulating that the Secretary of State will be involved in assessing the insurance arrangements which the Licensee is required to put in place. However, we have redrafted the condition to reflect in some part your concerns and hope this will be acceptable for this licence. The emphasis on consultation this licence will, hopefully, reduce any difficulties you may encounter with the Chinese. Once the licensing system is fully operational in Hong Kong to BNSC's satisfaction, it may be possible to reconsider this issue.
Condition 8.2 We consider that not only should the Secretary of State and the Governor be named insured but also they should both be satisfied in respect of any alternative form of security. We would therefor wish to retain "them" or to replace it with "the Secretary of State and the Governor".
You will note that the SI No. is incomplete in the Note prefacing the licence itslf and in the definition of Condition 13. I understand this will be available shortly and will telex you as soon as it is available.

We suggest the licence can now be shown to Asiasat. We have completed the technical assessment on Asiasat and see no reason to refuse a licence on technical grounds. significant issues remain outstanding:

A response is awaited from Beijing concerning the liability accepted by the PRC. The assurances given by CGWIC to Asiasat on 16 March do not adequately cover HMG's position. The FCO are seeking an urgent response see Tel No 383. Unless this is full acceptance by the PRC up to seperation there are likely to be ramifications for the insurance position i.e. Asiasat would have to insure from launch rather than seperation.
