We do not see the need for this amendment as 2.1 covers Asiasat for procuring the launch and 1.1 from the moment of launch. If a definition of launch is essential to Asiasat we would suggest the wording used in the insurance agreement be utilised "A period commencing with the intentional ignition of the launch vehicle" (see my fax of yesterday) be inserted into 1.1 line 1.
Condition 6.8.
It is very late in the day to be notified of such a major change to the structuring of Asiasat to that noted in the licence application form. Mr Bradshaw has now faxed outline details of the possible changes to me. I will endeavour to obtain a line a soon as possible but this will not be available before 3 April PM. On the surface, luckily, both proposals will not present difficulties sufficient to seriously delay issuing the licence or require major amendments (please pass this on to Mr Bradshaw). The licence, as drafted, will encompass most, if not all, of the activities to be undertaken by Asiasat in both potential restructuring. Although it will be necessary to obtain the approval of the Governor to the any restructuring proposal before it can be implemented. BNSC should be consulted on the application for consent as this could give rise to matters affecting the UK's international obligations. However, it does occur to me that what is proposed could require a licence or some other form of approval from either the American or Swedish authorities. Asiasat may wish to consider this point.
Condition 8.
The insurance condition 8 should be read in conjunction with the preceding condition regarding the indemnity (Condition 7). The provision of the insurance in no way diminishes Asiasat's obligations under Section 10 of the Outer Space Act as extended to Hong Kong. Condition 8 should remain as drafted. It is the applicants' responsibility to satisfy himself that the insurance level obtained is satisfactory for his purpose.
