Schedule amended

The Schedule is amended by repealing paragraph 5(4A) and

substituting

-

(a)

"(4A) The immunity from civil and administrative

jurisdiction in sub-paragraph (3) (a) shall not apply to -

supporting staff who are not designated by the

Government of the People's Republic of China as

being of diplomatic rank in respect of acts

performed outside the course of their duties as

such; or

(b) dependants of such supporting staff."

Explanatory Memorandum

The object of this Bill is to amend the Privileges and

Immunities (Joint Liaison Group and Land Commission) Ordinance to

grant privileges and immunities to the dependants of certain

categories of Chinese officials of the Joint Liaison Group and the

Land Commission.

2. As such dependants will be exempted from certain categories of

taxation, there will be minimal reduction in Government revenue.

This Bill has no Public Service staffing requirements.
