(g) perform such other functions as are imposed on it under this

Ordinance or any other enactment; and

(h) apply its resources towards the performance of its functions specified or referred to in this section, in particular the promo- tion, development and maintenance of hospital services.

5. Powers of the Authority

The Authority may do all such things as are necessary for, or incidental or conducive to, the better performance of its functions and in particular but without prejudice to the generality of the foregoing, may—

(a) for the provision of hospital services, enter into and carry out, any agreement with the Government or any other person for the management and control by the Authority of

(i) any property held, or managed. and controlled, by the

Government or the person;

(ii) any employee of the Government or the person; or (iii) the Hospital Services Department of the Government;

(b) acquire and hold property of any description if in the opinion of

the Authority such property is necessary for-

(i) the accommodation of the Authority or of any committee;

or

(ii) the performance of any function which the Authority may

perform,

and, subject to the terms and conditions upon which such property is held, dispose of it;

(c) enter into, carry out, assign or accept the assignment of, vary or

rescind, any contract, agreement or other obligation;

(d) provide in public hospitals, whether by itself or by other persons under agreements entered into with them, facilities for the purchase and consumption of food and drink, and such other amenities and facilities as the Authority is of the opinion are necessary or expedient to provide for the benefit of patients in, the staff of, or visitors to, public hospitals;

(e) establish and maintain such hospital services as the Authority con-

siders necessary or desirable for the purposes of this Ordinance; (f) erect, provide, equip, maintain, alter, remove, demolish, replace and improve the buildings, premises, furniture and equipment used by the Authority for the provision of hospital services subject to the terms and conditions upon which any such property is managed and controlled pursuant to an agreement referred to in paragraph (a);

5.

醫管局的權力

醫管局可辦理一切為更有效執行其職能而必須辦理或連帶須辦理的事情,或對更 有效執行其職能有助益的事情,並可在不影響前文的一般性的原則下,辦理以下事 情——

(a) 為提供醫院服務而與政府或其他人訂立及執行協議,以便由醫管局管理

及掌管一

(i)由政府或該人持有或管理並掌管的財產;

(ii)政府或該人的僱員;或

(iii) 醫院事務署;

(b) 取得及持有醫管局認為需要的任何類別的財產供以下用途————

(i) 醫管局或任何委員會辦公;或

(ii) 醫管局執行該局可執行的職能,

及在持有該等財產所根據的條款及條件規限下,處置該等財產;

(c) 訂立、執行、轉讓或承讓、更改或撤銷任何合約、協議或其他責任;

(d) 自行在公營醫院內提供購買飲食和進食的設施,以及醫管局認為為公營 醫院的病人、員工或訪客的利益而有需要或適宜提供的其他設備及設施 ,或訂立協議由其他人提供該等設施或設備:

(e) 為實施本條例而設立及維持醫管局認為有需要或應當設立及維持的醫院

服務;

(f)建造、提供、裝備、保養、更改、移走、拆卸、替換及改善醫管局用作 提供醫院服務的建築物、房產、家具及器材,但如該等財產是(a)段所指 協議而由醫管局按某些條款及條件管理及掌管,則辦理這些事情時須受 該等條款及條件所規限:
