The

Hospital Authority Ordinance which was
enacted on 27 July 1990 provides for the establishment of a Hospital Authority (HA) to manage and control public hospitals.
The HA WAS established on
Civil
1 December 1990 and the taking over of the management and control of all the government and subvented hospitals will be some time in mid 1991. servants, mainly professional departmental grades currently working in the Hospital Services Department and Department of Health will have three years to decide whether to transfer
to transfer to HA's employment or to remain on their present terms of service as civil servants.
Το encourage government hospital staff to transfer to HA's employment, it
is proposed to offer existing staff the option of mixed service pension terms or frozen pension terms on transfer to HA SO as to preserve their pension earned in civil service.
A Pension (Special Provisions) Hospital Authority Bill will be drafted to enable the extension of the pensions legislation (Pensions Ordinance Cap 89 and Pension Benefits Ordinance Cap 99 and their subsidiary legislation) to these transferred staff.
It is our intention to suspend monthly pension of retired officers who are appointed by HA. In this connection, HA will be determined public service for the purpose of pension suspension under Section 26 of Pension Benefits Ordinance Cap 99 or Section Pension Ordinance Cap 89.
