HONG KONG: GENERAL COMPENSATION SCHEME FOR MEMBERS OF HER MAJESTY'S

OVERSEAS CIVIL SERVICE (HMOCS)

PROBLEM

1.

We have now agreed with Hong Kong the details of a general

compensation scheme for HMOCS members. How should we proceed with

this within the Government here, with the Chinese, and in Hong

Kong?

RECOMMENDATION

2. I recommend that the attached draft OD (K) paper be circulated

amongst colleagues, that we consult the Chinese over the scheme at

JLG XV and that a joint ODA/FCO Team go to Hong Kong to promulgate the scheme in due course later this year.

BACKGROUND

3. There are some 800 officers in the Hong Kong Government and in

the Royal Hong Kong police force who are or have the option to

become members of HMOCS. HMG have an obligation to see that HMOCS

officers are appropriately compensated for the change in their

status arising from the transfer of sovereignty in 1997. This

obligation was inshrined in a white paper of 1960 which set out

general principals of governing the treatment of HMOCS officers in
